Overview

The recent decision of the Supreme Court in Ivey v Genting Casinos (UK) on the test for dishonesty has created a flurry of discussion and will lead to a change of approach in professional disciplinary cases. The Supreme Court determined that the two strand test commonly applied in regulatory proceedings from the case of R v Ghosh [1982] EWCA Crim 2 is now one single standard. This decision is likely to have a significant impact on regulatory cases, eliminating the requirement that the defendant/respondent must have realised, by the standards of ordinary, honest people, that the behaviour in question was wrong.

ARDL is delighted to provide a forum for consideration and discussion of this important case and its impact on regulatory cases more broadly. Speaking will be Richard Spearman QC appeared for appellant in the Ivey case. Chairing is The Hon Mr Justice Mostyn, who has heard several regulatory appeals involving discussion of the test for dishonesty in regulatory proceedings, and, in particular, considered the ‘Ghosh’ and ‘Twinsectra’ approaches in the case of Kirschner v General Dental Council [2015] EWHC 1377.

There will be time for questions and discussion.
