ARDL is hosting this in-person seminar to look at some current hot topics in regulation. Scotland’s courts have recently been engaged in considering the tests for these orders and have provided fresh guidance on when the public interest is engaged and the effect of delay on such cases. David Blair, Advocate, has appeared in several such cases where the Inner House of the Court of Session has overturned some ;landmark cases. David will discuss the recent jurisprudence and offer guidance on the dos and don’ts on interim orders. Freedom of speech and its limits for registered professionals is one of the hottest topics in regulation just now. Gary Burton will examine some of the case law around the limits of freedom of expression and when professional codes may be breached, social media comments on wars, politics, gender and more will be covered. Public inquiries are now leading to public concern as to the conduct of professionals, whether legal, financial or other areas with regulatory investigations either underway or likely. Catriona Watt, currently acting for clients at the Post Office Horizon IT Public Inquiry, the Scottish Child Abuse Inquiry and the Scottish Covid Inquiry will explore the link between what is uncovered at our public inquiries and what it means for professionals.
