The seminar will be of interest to ARDL and JARDL members who act for Regulators and those who act for Registrants. Our speakers will cover key issues to consider when drafting charges and material considerations when responding, including the often thorny issue of whether to respond at all.
Vivienne Tanchel – 2 Hare Court
Vivienne’s practice focuses exclusively on representing professionals before their regulators, in criminal courts, inquests, the High Court and in internal disciplinary investigations. Vivienne appears before all the healthcare regulators including the Medical Professionals Tribunal and the General Dental Council. She frequently appears before Performers List Decision Panels for GP’s and Dentists and has assisted both healthcare and financial professionals in internal investigations and hearings.
Before coming to the Bar, Vivienne worked in the city for 15 years and has adapted the skills of resilience, quick thinking on her feet and courage to her practice at the Bar.
Some of Vivienne’s recent cases include a successful appeal to the Administrative Court of a decision of the Medical Practitioner’s Service Tribunal, a successful Judicial Review of a decision of the GMC, representing the General Osteopathic Council in a complex case of sexual misconduct by a registered Osteopath and representing the Institute of Chartered Accountants of England and Wales in presenting a detailed complicated case against a medium sized well known accounting firm.
Vivienne represents interested persons at both Article 2 (including those with juries) and Jamieson inquests. Her clients include NHS trusts, Consultants, GP’s and nurses.
Peter Mant – 39 Essex
Peter specialises in administrative law, mental capacity, and regulatory law. He is ranked as a leading junior in The Legal 500 and Chambers and Partners where he is described an “excellent advocate”, “calm in the eye of the storm” and “great on his feet”.
Peter has appeared in numerous High Court appeals and judicial review claims for and against regulators. The regulators that he has acted for and/or advised in recent years include the General Medical Council (GMC), Professional Standards Authority (PSA), General Dental Council (GDC), Royal College of Veterinary Surgeons (RCVS), Solicitors Regulation Authority (SRA), Bar Standards Board (BSB) and Royal Institution of Chartered Surveyors (RICS). He also acts for regulated professionals, companies and trade unions.
He is a contributor to two of the leading textbooks on regulatory law: Disciplinary and Regulatory Proceedings (10th Ed) and The Regulation of Healthcare Professionals (2nd Ed).
Chair: Clare Chapman (non-practising solicitor)
As a practising Solicitor, Clare spent almost 22 years advising healthcare professionals in regulatory and disciplinary proceedings, first working at RacliffesLeBrasseur and then at BLM where she led the healthcare professional discipline and regulatory team until her departure in March 2022. Clare now works as an Adviser in the Practitioner Performance Advice Service (part of NHSR), giving impartial advice on the fair management of performance concerns.
